Hazardous Waste
Legislation: The Hazardous Waste (England and Wales) Regulations 2005 (Replaced the Special Waste Regulations 1996).
The Philosophy: Is to ensure safe management of hazardous waste and to provide cradle-to-grave documentation for the movement of hazardous waste.
Who does it apply to?
Anyone who produces, imports, carries, keeps, treats or disposes of controlled hazardous waste from business or industry or acts as a waste broker in this respect.
In a Nutshell:
- Registration to the Environment Agency for producers of hazardous waste to be done annually for a fixed fee (see below).
- Increase in the number of wastes classified as hazardous.
- No pre-notification for waste consignments however a consignment note system must be adhered to (see below).
- Fixed penalty charges of £300 per minor offences.
- Transaction fee from waste disposal site to the Environment Agency.
- Mixing of different categories of Hazardous waste prohibited.
- The term ‘Special’ will be replaced with ‘Hazardous’.
Please note: that wastes from interceptors are an absolute entry (A) under 13 05 03 and hence become hazardous irrelevant of the percentage of oil.
The Duty of Care
Legislation: The Environmental Protection (Duty of Care) Regulations 1991
The Philosophy: To place a duty on everyone who has responsibility for controlled waste to ensure that it is managed properly and recovered or disposed of safely.
Who does it apply to?
Anyone who produces, imports, carries, keeps, treats or disposes of controlled waste from business or industry or acts as a waste broker in this respect.
Paperwork:
Should Include:
- Information describing the physical and chemical composition, hazard characteristics, incompatible substances and handling precautions.
- The European Waste Catalogue Code (EWC) which applies to the waste (see below for link to full list).
- Quantity removed and container type.
- The company name, contact details, address, postcode and signatory for the producer (consignor). Paperwork to be kept for a minimum of 2 years.
- The company name, contact details, address, postcode, vehicle registration and signatory for the carrier. Paperwork to be kept for a minimum of 2 years.
- Quantity received at disposal site.
- The company name, contact details, address, postcode, vehicle registration and signatory for the consignee (disposal site). Paperwork to be kept for lifetime of site.
